Terms of sale
Last updated: «DATE»
1. Who we are
RiskPass is a trading name of «FULL NAME», a sole trader based at «TRADING ADDRESS», United Kingdom. Contact: «CONTACT EMAIL».
2. What we provide
We generate a Risk Assessment and Method Statement document from information you supply, using an automated system. You receive it as an editable Word file and a PDF.
We do not provide health and safety advice, consultancy, or professional certification. We do not inspect your site, review your work, or verify anything you tell us. We are not your health and safety adviser and no professional relationship is created by your purchase.
3. Your responsibilities
You confirm that you, or the person in control of the work, are competent to assess the risks of the work described.
The document we produce is a starting point. Before it is used on site you must review it in full, verify it reflects the actual work and conditions, and amend it as necessary. Responsibility for the adequacy of the risk assessment and method statement, and for compliance with health and safety law, remains entirely yours.
You are responsible for the accuracy of the information you give us. The document reflects what you told us; if that is wrong or incomplete, the document will be too.
4. Price and payment
The price is £29 including VAT where applicable. Payment is taken by Stripe. We do not see or store your card details.
We are not currently VAT registered. No VAT is charged and no VAT invoice can be issued.
5. Delivery and your cancellation rights
The document is generated immediately and delivered by email and download.
Where you are buying as a consumer, you would normally have 14 days to cancel. Because the document is supplied immediately, you must expressly consent to immediate supply and acknowledge that you lose the right to cancel once the document has been generated. You give that consent by ticking the box at checkout. Without it we cannot deliver immediately.
Most customers buy in the course of a business and this right does not apply to them.
6. Refunds
See our refund policy. It forms part of these terms.
7. Intellectual property
You own the document we generate for you. You may edit it, put your own branding on it, and issue it to clients, principal contractors and your own workers without restriction.
You may not resell our service, use it to operate a competing document generation service, or generate documents in bulk for onward sale.
8. Availability
The service depends on third parties including Stripe, Supabase, Resend, Anthropic and postcodes.io. We do not guarantee uninterrupted availability. If we cannot deliver your document, we refund you in full.
9. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
Subject to that, our total liability arising from or connected to your purchase is limited to the amount you paid us for the document in question.
We are not liable for any loss arising from your use of the document, including but not limited to enforcement action, rejection by a principal contractor, project delay, contractual loss, loss of profit, or any incident occurring during the work. This reflects the fact that the document is a draft aid which you must review and adapt, and that we have no knowledge of or control over the work or the site.
Where you buy in the course of a business, we exclude all implied terms as to satisfactory quality and fitness for purpose to the fullest extent the law allows.
10. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
11. Changes
We may change these terms. The version in force is the one published when you buy.
